O Procon Sumaré, órgão municipal de Defesa do Consumidor (CDC), realizou recentemente uma “blitz” para fiscalizar casos de propaganda enganosa ou abusiva praticada em postos de combustível da cidade. Os agentes estiveram em seis endereços e notificaram três locais por desacordo com o Código de Defesa do Consumidor.
Um exemplo de propaganda enganosa pode estar na promoção, expondo em destaque preços mais baixos do que são cobrados nas bombas e, em letras muito pequenas, a observação de desconto válido em horários restritos. De acordo com o CDC, o preço deve ser apresentado de forma clara, precisa e ostensiva.
O órgão orienta o consumidor que se sentir lesado, induzido ao erro, a exigir o cumprimento da oferta – é um direito previsto em lei! – e fazer a denúncia, comprovando a irregularidade por meio de fotos, cupom fiscal, entre outros.
