Conforme a polícia, as investigações começaram depois que balões caíram dentro do Aeroporto Internacional de Viracopos, em maio deste ano.

A suspeita é de que a confecção desses artefatos tenha acontecido na fábrica fechada nesta terça, instalada em uma casa.

No endereço, os policiais apreenderam cinco balões de aproximadamente dez metros de comprimento cada um e 15 quilômetros de linha cortante.

A Polícia Civil ainda informou que já identificou suspeitos de integrar grupos que fabricam e soltam os balões. No entanto, ainda não houve prisões.

Crime

Quem for flagrado soltando balão pode responder ao artigo 261 do Código Penal Brasileiro, que trata da exposição de perigo a embarcações ou aeronaves próprias ou de terceiros, bem como de qualquer ato que dificulte ou impeça a navegação marítima, fluvial ou aérea. Nesse caso, a pena de reclusão varia de dois a cinco anos.

Fabricar, vender, transportar e soltar balões também é crime previsto no artigo 42 da Lei nº 9.605/98, dos crimes contra a flora: “fabricar, vender, transportar ou soltar balões que possam provocar incêndios nas florestas e demais formas de vegetação, áreas urbanas ou qualquer tipo de assentamento humano”.

A pena é de prisão de 1 a 3 anos, ou multa, ou ambas, cumulativamente. Vale ressaltar que crimes ambientais são inafiançáveis.
